Florida Statute 718 – Updated through 2025 Overview

Florida’s Condominium Act (Chapter 718, F.S.) has evolved significantly since 2017 to strengthen transparency and accountability across condominium associations.

The first version of the website requirement, introduced by HB 1237 (2017), applied only to large associations. Since then, amendments passed in 2018, 2024, and 2025 — including HB 1021, SB 1178, HB 913, and SB 1742 — have expanded both the scope and content of what associations must publish online.
Today, most Florida condominium associations must maintain a secure website or portal that provides owners with online access to official association records.

Here Is What You Need to Know

Who Must Comply
  • Associations with 150 or more units: Required to comply since January 1, 2019.
  • Associations with 25 to 149 units: Must comply by January 1, 2026.
The rule applies to all residential condominium associations in Florida that do not include timeshare units.
What the Law Requires
Each condominium association must maintain an official association website or secure portal to host specific governing and financial documents.
The website must be:
  • Fully controlled by the association, whether self-managed or through a third-party provider; and
  • Accessible online with a restricted area (protected by individual usernames and passwords) for unit owners and authorized staff.
  • Associations are responsible for ensuring the website remains accessible, up to date, and compliant with all confidentiality and redaction requirements.
Required Documents to Post Online
As of the 2025 legislative updates, associations must post and maintain current digital copies of the following:
  • Declaration of Condominium and all amendments.
  • Bylaws and amendments.
  • Articles of Incorporation filed with the Department of State and amendments.
  • Association rules and policies.
  • Minutes of all board and committee meetings held within the past 12 months.
  • Video recordings (or direct links) of meetings conducted virtually within the last 12 months.
  • Approved budgetsproposed budgets, and financial statements.
  • Contractsleases, and bids for goods or services.
  • Director certifications and conflict of interest disclosures.
  • Structural inspection reports and reserve studies.
  • Permitsaffidavits, and investment policy statements, when applicable.
  • Notices and agendas for all meetings, posted at least 14 days in advance, including any documents that will be discussed or voted on.
  • Associations must also ensure that protected information — such as personal owner data or attorney-client communications — is properly redacted before uploading.
Penalties for Non-Compliance
Failing to comply with Chapter 718’s website requirements can result in state penalties, complaints filed by owners, and enforcement actions by the Florida Department of Business and Professional Regulation (DBPR).
